New York Workers Comp – NYSIF Fines Governor Hochul’s Campaign
The New York State Insurance Fund (NYSIF) recently sued their own Governor’s campaign committee for a $50K fine. I originally came across this article from a Claims Magazine newsletter covering this New York workers comp situation. No, this is not a politically-based article as none on this website have ever been slanted one way or the other.
Any time that a State Fund, in a rather bold move, is suing their own Governor’s election committee for no New York Workers Comp coverage, it should be covered in a Workers Comp blog such as this one.
All states have a worker maximum before an employer is required to acquire a workers comp policy to cover its employees in case of an on-the-job injury. New York workers comp coverage has no minimum number of employees. Almost all employers are required to carry workers comp coverage no matter the size – even sole proprietors.
Some states allow up to four employees without requiring a workers comp policy in place for that employer. New York starts at one employee including self-proprietors.

According to state officials, Hochul’s campaign failed to carry workers’ comp insurance from Dec. 30, 2022, to September 6, 2023 — following her 2022 election victory.
Hochul campaign spokeswoman Jen Goodman responded, “The Hochul campaign became aware of a matter with the Workers’ Compensation Board today and is actively working with the board to resolve any questions.

The actress Tina Fey faced the same scenario for not providing New York Workers Comp coverage to some of her staff. The 2014 article said that the actress was fined $79,000. Then a few weeks later, an article was published that her staff was likely covered by a policy. You can find that article here.
Governor Hochul’s campaign may have had coverage in place such as Tina Fey did in 2014. I will update this article or write another one when or if any more information is released on this unusual New York workers comp situation.
